Zipris LaValle’s Receivership Practice focuses on business insolvency and creditors’ rights in court receivership proceedings in South Florida. We are well versed in the complexities and intricacies of the law. Our attorneys conduct receiverships for businesses and real estate in distress. We counsel our creditor clients in receivership proceedings with regard to debt restructuring, as well as the collection and enforcement of secured and unsecured obligations. 

Zipris LaValle represents both creditors and receivers in receivership proceedings. On behalf of creditors, the firm procures the appointment of receivers to manage income property during foreclosure, monitors the status of receivership, and assists with all matters necessary to bring the receivership to successful termination. We also assist receivers in complying with their statutory, judicial and fiduciary duties. Our highly specialized representation of receivers takes into account their unique accountability to the court and the parties to an action.

Acting as a receiver and charged with assuming control of struggling businesses, marshalling their assets, and enhancing their value, to ultimately sell them as a going concerns. In addition to serving as receiver, Zipris LaValle represents struggling companies which may be exploring the possibility of being petitioned into receivership. In many instances, we have been able to assist clients in averting receivership or bankruptcy by restructuring the company and/or its debt structure or by introducing our clients to investors willing to infuse new capital or extend additional credit. When receivership is the appropriate alternative, we counsel our clients and assist them in gaining a full understanding of the receivership process.
